We are thrilled to share that Brooklyn District Attorney Eric Gonzalez wrote an op-ed for the New York Daily News in support of the Ceasing Repeated and Extremely Egregious Predatory Behavior Act, aka the CREEP Act. Earlier this year, our firm announced our renewed support for New York State bill S3394/A3226 which protects all New Yorkers who are being stalked.
The present law in New York only civilly protects stalking victims who are related to or have had an “intimate relationship” with the person stalking them. Article 8 of the Family Court Act grants Orders of Protection (OPs) to only these two categories of people, leaving many stalking victims with no civil recourse.
The CREEP Act provides all New York stalking victims with the right to petition for a Civil OP, regardless of the nature of the relationship they have with the person stalking them. Civil OPs are surprisingly effective at stopping stalkers and are simple and streamlined for victims to obtain.
Right now, the only recourse New York stalking victims have is to report the harassment to law enforcement. After a report, and only once an arrest is made by the police, can the DA prosecute the criminal case. DA Gonzalez and his Office have invaluable insight into how this process works, which makes it exceptionally compelling that he believes stalking victims should also be granted access to civil remedies. We are very grateful for DA Gonzalez’s support and the work that his office does to keep New Yorkers safe.
